O R D E R

The Writ Petition is filed seeking for issuance of mandamus directing the respondent to grant eligibility for 60 students admitted in the petitioner-College for the academic year 20182019 for the B.Ed course.

2. The petitioner-College is imparting teaching education by running B.Ed course and obtained recognition from National Council for Teacher Education (NCTE) in the year 2005 and has also been affiliated with the respondent-University. For the academic year 2018-2019, the petitioner-College had admitted 60 students, for which, there was no recognition.

3. It is stated by the learned counsel for the respondentUniversity that the respondent had issued a Show Cause Notice to the petitioner during the month of September 2017. It is now stated by the petitioner in the affidavit that the petitionerCollege tried to upload the student list on 08.08.2018 and the especial link for the petitioner-College did not open due to https://hcservices.ecourts.gov.in/hcservices/

technical problem and that they could not upload the list of students. Therefore, the petitioner-College has approached the University in person and gave a representation on 10.09.2018. Thereafter, repeated reminders have been given by the petitioner-College seeking eligibility to the admitted 60 students and certificate verification, which has not been responded by the respondent-University. Therefore, the above Writ Petition is filed for a mandamus as stated supra.

4. Heard both sides and perused the materials available on record.

5. The petitioner has been giving repeated representations on various dates i.e., on 10.09.2018, 26.09.2018, 17.10.2018, 15.11.2018, 09.01.2019, and 07.02.2019. Without affiliation or recognition from the respondent/University, the students cannot be admitted. As the future of 60 students are at stake, the respondents is directed to consider the case of the petitionerCollege as per their representations. The petitioner is directed to submit all the particulars to the respondent within a period of one week from the date of receipt of a copy of this order. On receipt of the same, the respondent is directed to pass appropriate orders on the representations of the petitionerCollege, on merits and in accordance with law, after issuing notice to the petitioner as well as the persons interested in this regard and also affording them an opportunity of personal hearing, within a period of three weeks thereafter.

6. With the above direction, the Writ Petition is disposed of. No costs.
