ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to judicial custody on 30.03.2022 for the offences punishable under Sections 341, 294(b), 336, 427, 392, 397 and 506(ii) of IPC in Crime No.148 of 2022, on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioner along with other three accused had robbed a sum of Rs.500 from the defacto complainant's Idly shop and damaged the shop. Hence, the complaint.
3. Learned counsel for the petitioner would submit that the petitioner is an innocent and there is no specific overt act against the petitioner and he has been falsely implicated in this case. He would further submit that the petitioner has been suffering incarceration from 30.03.2022. Hence, he prays for grant of bail to the petitioner.
4. Learned Government Advocate (Crl. Side) appearing for the respondent police raised objection for granting bail to the petitioner stating that the petitioner along with other accused had gone to the defacto complainant's Idly shop and demanded tiffin https://hcservices.ecourts.gov.in/hcservices/
without money and on refusal of the same, the accused attacked the defacto complainant and robbed Rs.500/- from him at knife point and also damaged the shop. He would further submit that the petitioner is arrayed as A2 and he is having 8 previous cases which includes section 307 of IPC.
5. Considering the fact that the petitioner is having 8 previous cases including for the offence under section 307 IPC, this Court is not inclined to grant bail to the petitioner.
