Mr.R.Anish Kumar COMMON ORDER The evidence of P.W.1 had been recorded in entirety and the witness had also been cross examined. At that stage, A.No.1995 of 2025 came to be filed to receive seven additional documents.
2. The nature of the documents has been listed out in the Judges Summons and a perusal shows that they are photographs of the testator
N.Venkatesan and invoices issued by SJBS Health Care Pvt. Ltd., Thereafter further applications have been filed to reopen the evidence of P.W.1 and to recall P.W.1 for the purpose of marking additional documents.
3. A common counter affidavit has been filed in all the three applications raising issues about the genuineness of the photographs produced and the learned counsel stated that they are not photographs, but screen shots taken from a mobile phone.
4. Naturally if the photographs are to cross the stage of admissibility, necessary certificate as envisaged to vouch for their genuineness will have to be produced. The relevancy of the said documents can also be questioned during the course of cross examination. Placing a caveat that necessary certificates have to be produced as envisaged under the Act, the documents are permitted to be marked, but I would rather put a time limit for recording of evidence.
5. P.W.1 to be present before the learned Additional Master III on 07.07.2025. The documents may be introduced and objections may be noted down by the learned Additional Master III. Thereafter, the witness may be cross examined limited to these documents on 14.07.2025 and again if required on 17.07.2025. The learned Additional Master III may thereafter proceed to record further evidence.
