ORDER : The Court Made the following order :- The petitioner was arrested and remanded to judicial custody on 25.04.2022 for the alleged offence punishable under Section 294 (b), 307 IPC in Crime No.139 of 2022 on the file of the respondent police seeks bail.
2.The case of the prosecution is that, the petitioner is known to the defacto-complainant. When the Defacto Complainant was using the bike of his friend who is also the friend of the petitioner, the petitioner was asking for the bike but the defacto complainant refused to handover the same, due to which, there was enmity between them. Subsequently, on the date of occurrence, the petitioner along with other accused had abused the defacto complainant in a filthy language, threatened him with dire consequence and also attacked the defacto complainant with knife, causing injury. 3.Learned counsel for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this case. He would further submit that the petitioner is suffering incarceration from 25.04.2022. Hence, prays for grant of bail to the petitioner.
4.Learned Government Advocate (Crl. Side) would vehemently oppose stating that the defacto complainant was attacked by the petitioner brutally with knife. He added that some of the accused in this case are yet to be secured and there are 11 previous cases pending against the petitioner. He would also submit that the petitioner is a history sheeter and Goondas proposal has also been initiated against the petitioner.
5.Considering the gravity of offence committed by the petitioner and also considering the fact that there are 11 previous cases pending against the petitioner and also a proposal for Goondas is pending, this Court is not inclined to grant bail to the petitioner. 6.In the result, the Criminal Original Petition stands dismissed. -sd/- 12/05/2022 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
