in C.P.No.78 of 2008 Two aspects are raised by the contributory and the secured creditor. The first relates to the assignment of a loan account to the Reliance Asset Reconstruction Company Limited. In the order dated 03.12.2021, it was recorded that the loan account relating to the company in liquidation was assigned to Reliance ARC. By communication dated 21.02.2022 from the Reliance ARC to the company in liquidation, it is stated that the entire outstanding dues against the relevant loan were received and that there are no dues payable. The said statement is recorded.
2. The other aspect pertains to the documents listed in the communication dated 06.05.1999 from the company in liquidation to the Indian Bank. It was previously recorded that the certified copies of the documents listed at Sl. Nos.1 o 3 thereof were obtained and handed over by the Indian Bank to the Official Liquidtor. As regards documents listed in Sl.Nos.4 to 12, Indian Bank states that they were 1 / 3
unable to obtain these documents in spite of taking efforts in that regard. Indian Bank further states that paper publication was issued in respect of these documents and a complaint was lodged with the police. On instructions, learned counsel for the Indian Bank undertakes that these documents would be handed over to the Official Liquidator immediately upon receipt in the event that such documents are found or obtained by the Indian Bank. The said undertaking is recorded.
3. In light of the above, nothing survives for adjudication in C.A.No.166 of 2022 and the said application is closed. 2 / 3
