ORDER
This writ petition has been filed for a direction, directing the respondents to consider the representation submitted by the petitioner to defreeze his account and permit him to operate.
2. The petitioner is holding an account with the first respondent in Account No.50200051901704. While being so, on instruction made by the second respondent, the first respondent had frozen the petitioner's account and did not permit the petitioner to operate his account on the ground that some of the crime proceeds, transferred to the petitioner's account. But the disputed amount is Rs.449/- alleged to be transferred in the account of the petitioner. However, the FIR was registered to the tune of Rs.1,38,000/-. Therefore, the first respondent had frozen the petitioner's account. Even according to the second respondent, the disputed amount is only Rs.449/- in the total sum of Rs.1,38,000/-.
3. In view of above, the first respondent is directed to mark a lien over the petitioner's account to the tune of Rs.449/- and permit the petitioner to operate his Account for the remaining amount.
4. With the above direction, this Writ Petition (Criminal) is disposed of. No costs.
5. Though notice was served on the second respondent and its name also printed in the cause list and there is no representation on behalf of him either in person or through counsel.
