Crime No.10 of 2020 Prayer: Criminal Original Petition filed under Section 438 Cr.P.C., praying to enlarge the petitioners on bail in the event of their arrest in Crime No.10 of 2020 on the file of the respondent police. ORDER

(This case has been heard through video conference) When the matter is taken up today, the learned Additional Public Prosecutor would submit that earlier the petitioners had filed Crl.O.P.No.12246 of 2020 and when the matter had come before the Court on 14.08.2020, a suggestion was made by the Court to the first petitioner to settle the matter with the defacto complainant, whereas, the earlier counsel has withdrawn the petition and now, the present application has been filed by a different counsel suppressing the earlier facts.

2. The petitioners have filed Crl.O.P.No.12246 of 2020 and the matter was listed on 14.08.2020. This Court had suggested the first petitioner to settle the matter with the defacto complainant. The learned counsel for the petitioner withdrew the petition. However, suppressing the earlier petition, the petitioners have filed the present petition through another counsel.

3. This Court is of the opinion that an attempt has been made to interfere with the administration of justice, I am inclined to dismiss the petition imposing a cost of Rs.5,000/- (Rupees Five Thousand only) each to be paid by the petitioners. The petitioners shall pay Rs.5,000/- (Rupees Five Thousand only) each to "The Chief Justice Relief fund, High Court of Madras, A/c.No.484101520, IFSC Code No: IDIB000M157, Indian Bank, High Court Branch". 4.With the above directions, this Criminal Original Petition is dismissed.
