ORDER

The petition has been filed to direct the respondent herein to settle the difference in gratuity amount due to increase in Dearness Allowance from 72 percent to 80 percent for the period from 01.01.2013 to 31.07.2013 to the petitioners herein with 6 percent interest by considering the representation of the petitioners dated 05.03.2026.

2. It is the case of the petitioners that they were appointed in the respondent corporation and retired from service on attaining their superannuation. It is the contention of the petitioners that the Dearness Allowance was revised from 72% to 80% . However, the said difference of 8% was not taken into consideration while settling their gratuity amount.

3. The petitioners had made a representation to the respondent to pay them the differential payment with interest. However, the same had not been considered to date by the respondent. Hence, the petitioners are before this Court.

4. Heard the learned counsel on either side and perused the materials available on record.

5. Considering the relief now sought for by the learned counsel for the petitioners, this Court, without going into the merits of the case, directs the respondent to consider the petitioners' representation dated 05.03.2026, on merits and in accordance with law and to pass appropriate orders, within a period of eight weeks from the date of receipt of a copy of this order and if the petitioners are found eligible, then the respondent is directed to pay the differential sum of Gratuity amount to the petitioners based on Dearness Allowances revision together with interest at the rate of 6%.
