Sagunthala v. S. Karthik

2025-07-11Honourable Mr.Justice Sathi Kumar Sukumara Kurup3 pages

C.M.P.No.9193 of 2025 in C.M.A.S.R.No.51264 of 2025 SATHI KUMAR SUKUMARA KURUP, J.

Earlier, the petition came up for hearing on 10.07.2025. Since the name of the Insurance Company was printed in the cause list, this Court expected that the learned Counsel appearing for the Respondent-2/Insurance Company would appear before this Court. Therefore, it was adjourned to 11.07.2025.

2. Today, 11.07.2025, the panel Counsel for the Insurance Company has not entered appearance.

3. Anyhow, considering the previous orders passed by this Court, the learned Panel Lawyer appearing for Insurance Companies/Transport Corporation, invariably has no objection in allowing the petition to condone the delay on the ground that the petitioners as Appellants shall not claim interest for the period of delay.

4. In the light of the general objections raised by the learned Counsel appearing for the Insurance Companies or Transport Corporation, this 1/3

petition is allowed on condition that the Petitioner is not entitled to claim interest for the period of delay of 11 days.

Registry is directed to number the Appeal if it is otherwise in order. 11.07.2025 shl 2/3
