CMP.No.8545 of 2020 and S.A.No.1189 of 2019 and Contp.No.425 of 2021 CMP.No.8545 of 2020 and S.A.No.1189 of 2019 and Contp.No.425 of 2021 KRISHNAN RAMASAMY, J., When the matter was taken up for hearing on 01.03.2021, this court passed the following order:

"This Court vide order dated 19.12.2019 dismissed the S.A.No.1189 of 2019, recording the undertaking affidavit filed by the petitioner to vacate the suit premises on or before 01.07.2020. Now, the petitioner has filed an application seeking extension of time for vacating the premises stating that due to Covid-19, he is not in a position to vacate the premises and seeks further two weeks to vacate the suit premises. 2.The learned counsel for the respondent submitted that the since the order of this Court dated 19.12.2019 was not complied with, the respondent has filed the Contempt Petition. 3.In view of the above, this Court is inclined to grant two weeks time to the petitioner to vacate the suit premises finally. The petitioner is directed to vacate the premises on or before 15.03.2021. It is made clear that, if the petitioner failed to vacate the suit premises on or before 15.03.2021, the Contempt Petition will be taken up and necessary orders will be passed. 4.List the case on 1703.2021."

ah 2.Today, when the matter was taken up for hearing, Mr.Abdul Mubeen, the learned counsel appearing for the petitioner/appellant submitted that the appellant, who is the tenant in the premise of the respondent has vacated and handed over the key to the respondent yesterday i.e. on 16.03.2021.

3.Mr.P.Gunaraj, learned counsel for the respondent also confirmed the above said fact and submitted that his client has received the key from the appellant/tenant.

4.In view of the submissions made by both the learned counsel nothing survives for adjudication in this miscellaneous petition, since the appellant handed over the key to the respondent. Hence, this miscellaneous petition in CMP.No.8545 of 2020 is closed and consequently, the contempt petition stands closed.
