Respondents Prayer:-Writ Petition filed under Article 226 of the Constitution of India to issue a writ of mandamus directing the respondents to pass orders for power delegation in the post of Executive Engineer [Planning] in Salem Corporation in favour of the petitioner consequent to his promotion to the post of Executive Engineer [Planning] as per G.O.[Pa] No.359, Municipal Administration and Water Supply Department, dated 09.09.2019 based on the representation submitted by the petitioner dated 22.05.2021 within a time frame to be fixed by this Court. ORDER

By consent, the writ petition is taken up for final disposal and is disposed of by this order.

This writ petition has been filed seeking mandamus, to direct the respondents to pass orders for power delegation in favour of the petitioner consequent upon his promotion as Executive Engineer [Planning] as per G.O.Ms.No.359 dated 09.09.2019 by considering his representation dated 22.05.2021.

The learned counsel for the petitioner would submit that the petitioner would be satisfied if a direction is issued to the 2nd respondent to consider the petitioner's representation dated 22.05.2021 within a time frame to be fixed by this Court.

The Court heard the submissions of the learned Government Advocate appearing for the respondents.

Though the petitioner has prayed for a larger relief, this Court, without expressing any opinion on the merits of the petitioner's representation dated 22.05.2021, directs the 2nd respondent to consider and dispose of the petitioner's representation dated 22.05.2021 on merits and in accordance with law and pass appropriate orders within a period of eight weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner herein.

The writ petition stands disposed of accordingly. No costs.
