The Criminal Appeal is filed under Section 378 of Code of Criminal Procedure to set aside the acquittal and judgment of the Principal Sessions Judge, Erode, in Crl.Appeal.No.126 of 2012 dated 16.10.2012 reversing the conviction imposed in Judgement dated 13/6/12 made in CC 99/04 on the file of District Munsif - cum - Judical Magistrate, Kodumudi.

JUDGMENT

When the criminal appeal was taken up for hearing on 07.08.2018, there was no representation on behalf of the appellant. Hence the matter was directed to be listed on 28.08.2018 "for dismissal".

Accordingly today the matter is listed under the caption "for dismissal". Today, when the matter is called for hearing, the learned counsel for the appellant seeks adjournment, which this Court is not inclined to grant, since the appeal is pending from 2013 and the counsel still is not ready to argue the matter on merits.

Hence, the criminal appeal is dismissed for non prosecution.
