This Criminal Original Petition has been filed by the petitioner/A3, who was arrested and remanded to judicial custody on 26.08.2021, seeking bail in C.C.No.83 of 2022 pending trial before the I Additional Special Judge for Exclusive Trial of Cases under NDPS Act, Chennai in R.R.No.32 of 2021 registered for the offence under Sections 8(c) r/w 22(C), 28 & 29 of NDPS Act.

The case of the prosecution is that based on secret information by the defacto complainant, who is the Intelligence Officer, on 24.08.2021, at about 9.10 a.m, when the defacto complainant intercepted the vehicle bearing Regn.No.TN 20 AR 5650, the petitioner along with other accused were found to be in illegal possession of 8 kgs of Methamphetamine weighing about 7.900 kgs. Hence, the complaint.

3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that he has nothing to do with the alleged offence and he has been suffering incarceration from more than 2 1⁄2 years. Hence, he prayed for bail stating that, the petitioner is ready to abide by any stringent conditions

that may be imposed by this Court.

Learned Government Advocate (Criminal Side) appearing for the respondent police raised objection stating that the petitioner along with other accused were found to be in illegal possession of 8 kgs of Methamphetamine weighing about 7.900 kgs, which is a commercial quantity. He would further submit that the investigation was completed and the charge sheet has also been filed. He further submit that the trial hase also been commenced and now the case is posted for examination of witnesses.

Taking into consideration the facts and circumstances of the case and the submission made by the learned counsel on either side and also considering the nature of offence and the quantity involved is a huge quantity, investigation was completed and the charge sheet has also been filed and the trial has also been commenced, this Court is not inclined to grant bail to the petitioner.
