CMP.Nos.9089, 9092 and 9093 of 2024 in A.S.No.341 of 2010 RMT.TEEKAA RAMAN,J., These Civil Miscellaneous Petitions are filed (i) to condone the delay of 2394 days in filing the petition to set aside the abatement caused due to the death of the appellant-T.Manickam (ii) to set aside the abatement caused due to the death of the appellant and (iii) to bring the proposed petitioners herein as the rank them as 3 to 6 legal representatives of the deceased appellant on record in the above Appeal Suit.

2.Heard both sides. The factum of the death of the appellantT.Manickam, in the Appeal Suit and their legal representatives are not in dispute.

3.Considering the submissions made on behalf of the learned counsel for the petitioner, and being satisfied with the reasons stated in the affidavits filed in support of these petitions, all these petitions are allowed as prayed for. 4.Registry is directed to carry out the necessary amendments in the cause title, within a period of three weeks and list the main appeal on 18.07.2024.
