The prayer in the petition reads as follows:- "to issue summons to the Income Tax Authorities / ACIT-1/Tiruppur to produce the income tax returns / along with Auditor Balance sheet and Auditor report (full set) submitted by the respondent (R.Balasubramanian / PANABEPB2074J) during the Assessment year 2008-2009." 2.Mr.V.P.Sengottuvel, learned counsel for the respondent has no objection for issuing summons as prayed for. He would however, point out that the Auditor's report may not available. Mr.A.K.Kumaraswamy, learned Senior Counsel appearing for the petitioner would submit that the other documents could be summoned.

3.In view of the consensus reached, this petition is ordered, Registry is directed to issue Subpoena to the Income Tax Authorities, Tiruppur to produce the Income Tax returns along with audited balance sheets of the respondent for the assessment year 2008-2009. Documents shall be produced by 18.06.2024.
