Criminal Original Petition filed under Section 482 Cr.P.C. with a prayer to call for the records in STC No.195/2014 on the file of the Judicial Magistrate No.IV, Salem and quash the same. For Petitioners :

When this Court was about to dismiss this petition on merits, Mr.B.Kumarasamy, learned counsel appearing for the petitioners sought permission to withdraw this petition with liberty to approach the trial Court and raise all points. Consequently, this petition is https://hcservices.ecourts.gov.in/hcservices/

dismissed as withdrawn with liberty to the petitioners to raise all points before the trial Court. Connected miscellaneous petitions are also dismissed.

At this juncture, Mr.B.Kumarasamy, learned counsel for the petitioners submitted that the petitioners 1 and 3 are ladies and the second petitioner is aged about 70 years, and therefore their presence before the trial Court may be dispensed with. In view of the said submission, the petitioners are directed to appear before the trial Court for (1) receiving the complaint; (2) for questioning on the accusation; (3) Section 313 Cr.P.C.; and (4) on the date of judgment. For all other hearing dates, petitioners' presence before the trial Court is dispensed with on condition that they give an undertaking before the trial Court that their Counsel will cross-examine the witnesses in their absence, and that, they will not adopt dilatory tactics to delay the proceedings. vr s/d- Assistant Registrar(CS-III) True Copy Sub-Assistant Registrar To The Judicial Magistrate No.IV.
