PRAYER: Transfer Civil Miscellaneous Petition filed under Section 24 of Civil Procedure Code, 1908 to withdraw HMOP No.934 of 2016 and HMOP No.1565 of 2016 pending on the file of the V Additional Family Court in Chennai and transfer two cases to the Principal Family Court in Coimbatore to try along with MC No.31/2023 currently pending on the file of the Principal Family Court in Coimbatore.

The Transfer Civil Miscellaneous Petition is filed to withdraw HMOP No.934 of 2016 and HMOP No.1565 of 2016 pending on the file of the V Additional Family Court in Chennai and transfer two cases to the Principal Family Court in Coimbatore to try along with MC No.31/2023 currently pending on the file of the Principal Family Court in Coimbatore.

2. When the matter was taken up for hearing, learned counsel for the respondent submits that HMOP No.934 of 2016 on the file of the V Additional Family Court in Chennai, has been filed seeking divorce, was allowed on 18.01.2024 and HMOP No.1565 of 2016 on the file of the V Additional Family Court in Chennai, has been filed seeking restitution of conjugal rights, was dismissed on 01.02.2024. Therefore, nothing survives for adjudication in the matter.

3. Recording the submissions made by the learned counsel for the
