Heard the learned counsel for the petitioner and the learned Government Advocate (Criminal Side), appearing for the respondent - State.

2. This petition is filed to grant permission to the petitioner to travel abroad (pilgrimage for the period between 4th June,2024, and 15th July,2024) and condone his absence for the above said period, pending disposal of the appeal.

3. In this case, sentence of imprisonment has already been suspended by this Court by an order, dated 04.03.2024.

4. In the given situation and considering the fact that the petitioner intends to visit pilgrimage during the period mentioned above to commemorate his religious tradition, for which he has applied for renewal of passport, this Criminal Miscellaneous Petition is allowed, subject to the following conditions :

(i) Petitioner shall file an Affidavit before the trial Court, providing the details of travel, ticket details and the date of return.

2/3 (ii) Petitioner shall file an Affidavit of Undertaking before the trial Court that he shall return and co-operate with the trial by attending Court hearings.

(iii) Petitioner shall not travel to any other country/countries than those mentioned in the Affidavit, mentioning the details of travel. (iv) Petitioner shall surrender the Passport on returning from pilgrimage to the trial Court.

(v) Petitioner shall intimate the trial Court on arrival from pilgrimage.
