ORDER : The Court Made the following order :- The petitioner herein who was arrested and remanded to judicial custody on 20.04.2022 for the offence under sections 294(b), 353, 506 (i), 328 IPC and 24(i) of COTPA Act in Crime No.295 of 2022 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that A1 is the supplier of banned tobacco products and based on the confession of A1, on investigation, the petitioner found in possession of banned tobacco products worth about Rs.1,82,000/-. Hence, the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent and he is running a small petty shop business and he is no way connected with the alleged offence. He would also submit that the petitioner has been suffering incarceration from 20.04.2022. Hence, he would pray for grant of bail to the petitioner.

4. Learned Government Advocate (Crl. Side) appearing for the respondent strongly opposed the grant of bail to the petitioner stating that A1 is the supplier of the banned tobacco products and A2 is a shop owner and based on the confession of A1, the petitioner herein/A2 was arrested. He would also submit that the investigation is still going on and one previous case is pending against the petitioner.

5. Considering the facts and circumstances of the case and the quantity of the contraband and the gravity of offence, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
