Criminal Original Petition filed under Section 482 of Cr.P.C., praying to direct the 2nd respondent herein to register a case based on the complaint given by the petitioner dated 09.09.2015.

O R D E R

This petition has been filed to direct the 2nd respondent police to register a case on the petitioner's complaint dated 09.09.2015.

2. Heard the learned counsel for the petitioner; learned Additional Public Prosecutor for the respondents and perused the materials placed on record.

3. It is seen that this petitioner's father suffered injuries in an assault and is said to be still in the hospital. The petitioner has not attached any proof for having given this complaint to the Commissioner of Police.

4. Under such circumstances, the petitioner is directed to give fresh complaint in person with wound certificate to the 2nd respondent police and on such complaint being given, the 2nd respondent is directed to enquire into the complaint and take action in accordance with law, as laid down by the Hon'ble Supreme Court in Lalita Kumari Vs. Government of Uttarpradesh and Others reported in (2014) 2 SCC 1.
