ORDER
This Criminal Original Petition has been filed seeking a direction to the learned Principal District and Sessions Judge (Special Court under SC/ST
Atrocities Act), Ariyalur, to consider the bail application of the petitioner herein in Crime No.76 of 2026 on the file of the second respondent, on the same day of his surrender.

The case of the prosecution is that due to political enmity, the petitioners have abused the de facto complainant and his men by referring to their caste name.

Heard the learned Additional Public Prosecutor for respondents 1 and 2 and perused the materials on record.

Considering the submission made and on perusal of the materials, it is seen that the de facto complainant, after attending a house-warming function of his party member, was proceeding along with the MLA and the District Secretary. At that juncture, it is alleged that about 20 persons arrived on motorcycle and restrained the vehicle of the de facto complainant. During the said occurrence, one among them is stated to have climbed on top of the car and abused the complainant and others by referring to their caste name and also extended criminal intimidation. The occurrence is stated to have taken place in a public place and in full public view. It is further submitted that the entire incident was recorded on a mobile phone and the same has been produced before the respondent police. Since the identity of the offenders was not fully
known, except the political functionary, the respondent police, without specifically naming the accused persons, have registered the first information report.

In view of the above factual position, there shall be a direction to the learned Principal District and Sessions Judge, (Special Court under SC and ST Atrocities Act), Ariyalur, to consider the petitioner's bail application, preferably on the same day of his surrender, in connection with Crime No.76 of 2026 on the file of the second respondent Police and to pass appropriate orders in accordance with law, after affording due opportunity to the victims under Section 15-A of the SC/ST (POA) Act, 1989. The petitioner shall surrender before the jurisdictional Court within a period of fifteen days from the date of receipt of a copy of this order.
