Petition filed under Article 226 of The Constitution of India praying to issue a writ of mandamus directing the respondents 1 to 3 to consider the Petitioner's representations dated 27.02.2017 and 10.04.2017 to cancel the Patta No.209 assigned to the 4th respondent for an extent of 2.07 acres of lands comprised in S.Nos.49/10A and 49/10 situated at Veeranakuppam Village, Uthangarai Taluk, Krishnagiri District and issue patta in the name of the petitioner. O R D E R
The petitioner has filed the above Writ Petition to issue a Writ of Mandamus directing the respondents 1 to 3 to consider the his representations dated 27.02.2017 and 10.04.2017 to cancel the Patta No.209 assigned to the 4th respondent, measuring an extent of 2.07 acres of lands comprised in S.Nos.49/10A and
49/10, situated at Veeranakuppam Village, Uthangarai Taluk, Krishnagiri District and issue patta in his name. 2.The learned counsel appearing for the petitioner submitted that the petitioner's representations dated 27.02.2017 and 10.04.2017 may be directed to be considered by the respondents. 3.Mr.S.N.Parthasarathi, learned Government Advocate taking notice for the respondents 1 to 3 submitted that the petitioner has not given any representation to the second respondent and therefore the petitioner may be directed to file an appeal before the 2nd respondent, and on filing the appeal, the second respondent may be directed to dispose of the same in accordance with law.
4. Having regard to the submissions made by the learned counsel on either side, I give liberty to the petitioner to file an appeal before the 2nd respondent within one week from the date of receipt of a copy of this order and on filing the appeal before the 2nd respondent, the 2nd respondent is directed to decide the same on merits and in accordance with law, within eight weeks from the date of receipt of the appeal, after giving notice to all the interested parties.
5.With these observations, the Writ Petition is disposed of. No costs.
