ORDER : The Court Made the following order :- The petitioner herein who was arrested and remanded to judicial custody on 15.03.2022 for the offence under sections 3(2)(a), 4(1), 5(1)(a) of the Immoral Traffic (Prevention) Act 1956 and 370(A)(2) of Indian Penal Code in Crime No.165 of 2022 on the file of the respondent police, seeks bail.

2. The case of the petitioner is that the petitioner along with other accused under the guise of running a massage centre in the name and style of Colours Unisex Saloon at Velacherry, have engaged young girls in flesh trade. Hence, the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent and he is only as a labourer in the said massage centre and he is no way connected with the alleged offence. He would also submit that the co-accused A4 has been released on bail and the petitioner has been suffering incarceration from 15.03.2022. Hence, he would pray for grant of bail to the petitioner.

4. Learned Government Advocate (Crl. Side) appearing for the respondent strongly opposed the grant of bail to the petitioner stating that the accused have engaged young girls in flesh trade under the guise of running a massage centre and totally, three https://hcservices.ecourts.gov.in/hcservices/

victim girls have been secured. He would submit that there are totally four accused in this case and the petitioner is arrayed as A2 and he acted as a broker and that A1 and A3 are still absconding. But admits that there is no previous case against the petitioner and A4 who is a customer has been enlarged on bail.

5. Considering the gravity of offence and some of the accused are still absconding, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
