ORDER

The petitioner herein apprehend arrest at the hands of the respondent police for the offences punishable under Sections 75(2) of BNS, 2023 and Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 2002 in Crime No. 20 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2. This is a case and a counter case. The prosecution of the case is that the petitioner was assaulted by four persons and thereby, he sustained severe injuries including damage to his spinal cord.

3. The counter case is that on 11.09.2025 at about 11.00 a.m, while travelling in an auto rickshaw from GH Central Station to WCC College, the auto driver allegedly compelled her to sit in the front seat and allegedly touched and pressed her chest during travel. Hence, the complaint.

4. The learned counsel appearing for the petitioner submitted that the petitioner is innocent person and he has been falsely implicated in this case. It was further submitted that the petitioner is ready to co-operate with the investigation and abide by any other stringent conditions that may be imposed by this Court. Hence, he prayed for the grant of anticipatory bail to the petitioner.

5. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner, who is aged about 52 years has misbehaved with 18 years old girl. Hence, he vehemently opposed the grant of anticipatory bail to the petitioner. 2/4

Considering the nature of allegations against the petitioner and taking into consideration of age of the victim girly, this Court is of the view that, if the petitioner is enlarged on bail, it would jeopardize the prosecution case, and cause mental trauma to the victim girl. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.
