O R D E R

Petitioner challenges the order of learned District Munsif cum Judicial Magistrate, Perundurai, passed in M.C.No.24 of 2007 on 31.03.2010.

2. Petitioner and first respondent were married on 28.06.2006 and they have one daughter, the second respondent herein. Informing that the petitioner avoided the respondents and was not taking care of them, they have filed M.C.No.24 of 2007 on the file of learned District Munsif cum Judicial https://hcservices.ecourts.gov.in/hcservices/

Magistrate, Perundurai, seeking maintenance. The Court below, under the impugned order, directed the petitioner to pay monthly maintenance in sums of Rs.1,500/- to each of the respondents. Against such order, this revision has been filed.

3. Heard learned counsel for petitioner and learned counsel for respondents.

4. It is an admitted position that the petitioner is getting reasonable income through ancestral and own property. Taking an overall view of the facts and circumstances, the Court below has noted that it was the duty of the petitioner to provide for his wife and daughter and as against the claim for maintenance in a sum of Rs.5,000/- p.m., has fixed a minimal sum of Rs.1,500/- as payable to each of the respondents. This Court finds that the order under challenge is a well reasoned one which does not call for any interference.

This Criminal Revision is dismissed. Consequently, connected miscellaneous petition is closed.
