Ms.R.Poornima COMMON ORDER Though an opportunity was given to the respondent to verify as regards payment of costs, learned counsel for the respondent states that she is yet to receive instructions from the client.
2. I have gone through the affidavit of service filed reporting compliance of the order dated 28.11.2024. The petitioner has taken a Demand Draft in D.D.N.318652 dated 03.12.2024 and has despatched by 1/2 https://www.mhc.tn.gov.in/judis
P.B.BALAJI.,J sr way of Registered Post and the same has also been sent to the learned counsel appearing before the trial court and the Demand Draft has been received.
3. Though the learned counsel for the respondent states that the demand draft has not been encashed, the petitioner cannot be punished twice since she has already taken a demand draft expending a sum of Rs.5,000/- and send it to the learned counsel for the respondent who is appearing before the trial court.
4. In the light of the above, I am inclined to record compliance of the order dated 03.01.2025 and the order dated 28.11.2024 shall therefore take effect.
5. It is open to the respondent to work out his remedy to encash the Demand Draft and if any co-operation is required from the petiitoner, the petitioner shall extend such co-operation.
