ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for offences punishable under Sections 308, 318(4), 319, and 340 of the Bharatiya Nyaya Sanhita (BNS), 2023, in Crime No.34 of 2026, seeks anticipatory bail.

2. The case of the prosecution is that the defacto complainant is a victim of online financial fraud amounting to Rs.1,50,000/-. It is alleged that this fraud occurred within the jurisdiction of Delhi. The allegation is that the complainant was deceived and cheated by person(s) impersonating others to induce the delivery of money. It is further alleged that forged documents or electronic records were used as genuine; hence, the registration of the case.

3. The learned counsel for the petitioner would submit that the petitioner received summons in relation to FIR No.34 of 2026, registered at Shahdara, Delhi. Although the FIR was registered on 14.02.2026, the petitioner received the summons only on 17.03.2026, necessitating the filing of this interstate anticipatory bail application. The learned counsel further submits that the petitioner, being unfamiliar with Delhi, requires time to approach the jurisdictional Court there. Without the protection of transit bail, the petitioner faces the risk of arrest before reaching the appropriate forum. He contends that

the petitioner runs a private financial consultancy, has no connection to the alleged offence, and has been falsely implicated. It is further argued that custodial interrogation is unnecessary.

4. This Court has perused the FIR, where the allegation involves a financial fraud of Rs.1,50,000/-. Considering the factual position and noting that the petitioner is a resident of Ramapuram, Chennai, as evidenced by the summons issued by the respondent police, this Court is inclined to grant interstate anticipatory bail. This protection is granted for a period of two weeks to enable the petitioner to approach the competent Court in Delhi for appropriate remedies.

Accordingly, interim interstate anticipatory bail is granted to the petitioner for a period of two weeks, subject to the condition that the petitioner shall surrender before the learned Judicial Magistrate - I, Poonamallee, within a period of seven days from the date on which the order copy is made ready and the petitioner shall execute a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties each for a like sum to the satisfaction of the said learned Magistrate.

6. Further, within the one-week period from the date of executing the bond, the petitioner shall approach the competent Court in Delhi. This order shall remain in force for two weeks from the date of receipt of a copy of this order or until orders are passed by the jurisdictional Court, whichever is earlier. Failure to comply with these conditions within the stipulated timeframe shall result in the automatic cancellation of this order.
