Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of mandamus directing the first respondent to dispose of the appeal No.Nil of 2014 dated 24.3.2014, filed by the petitioners on merits and in accordance with law.

ORDER

By consent, the writ petition itself is taken up for final disposal.

2.The first petitioner would state that the petitioners' father is the owner of the property admeasuring to an extent of 1.62 acres in Survey No.135, situated at Narayanapuram Village, Sholinganallur Taluk, Kancheepuram District, by means of a registered sale deed bearing Document No.1813/1952, and patta was also granted in his favour. The first petitioner would further state that their father died intestate on 9.7.2004, and the third respondent and his brother and sisters in collusion with the second respondent, managed to include their names in the original records, and obtained a joint patta in respect of the above said lands, and the petitioners, aggrieved by the same, preferred an appeal before the first respondent and since it has not been given disposal, came forward to file this writ petition.

3.Heard the submissions of Mr.P.Krishnan, learned Counsel appearing for the petitioners, and Mr.V.Subbiah, learned Special Government Pleader, who accepted notice on behalf of the respondents 1 and 2.

4.This Court, taking into consideration the limited scope of prayer sought for by the petitioners, and without going into the merits of the claim projected by them, directs the first respondent to dispose of the appeal dated 24.3.2014, filed by the petitioners, in accordance with law, after putting on notice, the respondents 4 to 8, within a period of eight weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioners as well as to the respondents 4 to 8. The writ petition is disposed of accordingly. No costs.
