The petitioner herein is arrayed as A2 in Crime No.16 of 2022 registered for the offence punishable under Sections 8(c), 20(b)(ii)(C), 25, 29 of NDPS Act. The petitioner seeks grant of bail in the said case. 1/4

The case of the prosecution is that the accused 1 was found in illegal possession of 340 Kgs of Ganja. Based on the confession of A1, the present petitioner has been arrayed as A2 in this case. 3.

The learned counsel appearing for the petitioner submitted that this petitioner has no way connected with the offence as alleged by the prosecution. He further submitted that the petitioner is suffering from a uterine condition and is currently undergoing medical treatment while in judicial custody. Therefore, he seeks bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent police opposed the grant of bail to the petitioner and submitted that, on the date of occurrence, the petitioner, along with A1, has travelled to Andhra Pradesh to procure the contraband. Based on the statement of A1 and supporting call detail records, it is established that there was communication between A1 and the petitioner and that the petitioner had travelled to Andhra Pradesh. He further submitted that the quantity of contraband seized is of commercial quantity and the petitioner has also involved another NDPS case. 2/4

5. Considering the above fact and the conduct of the petitioner, this Court is not inclined to grant bail to the petitioner. Hence, this petition for bail stands dismissed.
