By order dated 26.06.2024, this Court had suggested that the respondents to permit the applicant to participate in future tenders, if any, called for supply of water and the respondents counsel sought time to get appropriate instructions in that regard.

The learned counsel appearing for the respondents, on written instructions, would submit that the respondents are willing to permit the applicant to participate in future tenders provided he will not make any claim or raise any dispute of the past contract. The learned counsel for the applicant also further submit that the same is made to the peculiar facts and circumstances of the case.

Recording the said submission made by the learned counsel appearing on either side, no further adjudication is required to be made in this application and the applicant is permitted to participate in future tenders as and when it is called for. Since the statement made by the learned counsel for the respondent is made to the peculiar facts and circumstances of this case, this case cannot be treated as precedent in any other case. 4.
Accordingly, the application stands closed.
