Today, this matter is listed under the caption 'for being mentioned' at the instance of the learned counsel appearing for the 2nd Respondent.

2. Learned counsel appearing for the 2nd Respondent submitted that the Petitioner herein, who was employed with the 1st Respondent/Management, is drawing around Rs.2.04 lakhs as monthly salary after statutory deductions and that the said salary is not drawn on account of his employment elsewhere, as pointed out in paragraph 2 of the interim order dated 24.07.2019 made in the above Miscellaneous Petition.

3. Taking note of the said submissions, Registry is directed to substitute paragraph 2 of the order dated 24.07.2019 made in W.M.P.No.12991 of 2018 in W.P.No.20893 of 2017, with the following one: "2.

As it is represented that the Petitioner/person employed is drawing Rs.2.04 lakhs as monthly salary after statutory deductions, this Court is not inclined to order withdrawal of the amount lying to the credit of this Writ Petition. If an employee is drawing meagre sum as salary, which is less than minimum wages, then withdrawal of backwages can be permitted. Since the Petitioner/workman in the case on hand is drawing more than Rs.2 lakhs as monthly salary, this Court directs the Registry to deposit the amount lying to the credit of this Writ Petition in an interest bearing Fixed Deposit Scheme initially for a period of one year, renewable periodically and the Petitioner/workman is entitled to withdraw interest on the same once in three months, till the disposal of the Writ Petition.
