The Habeas Corpus Petition has been filed to direct the respondents to produce the petitioner's sister M.Rajeswari, wife of Arjunan, aged about 26 years, along with her minor daughter Krithika, aged about 5 years before this Court. https://hcservices.ecourts.gov.in/hcservices/
2. The petitioner states that his sister is under illegal custody of Mr.Arjunan and therefore, lodged a complaint before the 2nd respondent Police.
3. The learned Additional Public Prosecutor made a submission that investigation reveals that the detenue is now residing along with one Mr.Kumar, who was a neighbour to the detenue and both are residing at Vellore and the detenue has fallen in love with the said Kumar and residing with him. The detenue has given a statement on 13.05.2022 before the Inspector of Police, D3 Podhanur Police Station, Coimbatore.
4. In view of the statement given by the detenue before the Inspector of Police, we are able to form an opinion that the detenue is not in illegal custody and she is residing along with one Mr.Kumar at Vellore, at her own volition.
5. This being the factum established, the Habeas Corpus Petition deserves no further consideration and accordingly, stands dismissed.
