C.M.P.No.18395 of 2016 in O.S.A.No.205 of 2016 Nooty.Rammohana Rao,J and Dr.Anita Sumanth,J Order of the Court was made by Nooty.Rammohana Rao,J This petition is taken out seeking extension of time for complying with the order passed by us on 17.10.2016 in O.S.A.No.205 of 2016.

2. In the affidavit sworn to in support of this petition, though it is remarked that the Bench has not decided the matter on merits, we made our position very clear that such a statement is far from accurate. We have, in fact, gone into the merits of the matter and decided the original side appeal. The only thing that we have done was not to advert to the contentions canvassed in extenso, as, half way through the submissions, there were some consensus that have emerged.

3. Be that as it may, the learned counsel would submit that the party never intended to pass any comment on the order passed by us on 17.10.2016 and he sincerely regrets the error that unwittingly crept in the affidavit in this regard.

Going by the contents of the affidavit filed in support of this petition and also taking into account and consideration the contemporaneous facts, we consider that it would be appropriate to grant extension of time till 15.12.2016 to comply with our order dated 17.10.2016. It is made clear that if the order passed by us dated 17.10.2016 does not get complied with by 15.12.2016, the order stands neutralized automatically without any further reference to this Court.

5. The above civil miscellaneous petition stands ordered accordingly.
