O R D E R

The instant writ petition has been filed with a prayer for issuing a Mandamus, to direct the respondents to disburse the leave encashment benefits to the petitioner which he entitled for the period of 02/2019 with interest at the rate of 12% per annum from the said date of entitlement to till the date of actual disbursement.

The case of the petitioner is that the petitioner was appointed as Traffic Inspector in the 1st respondent Transport Corporation and after completion of unblemished service, the petitioner had retired from service on 31.03.2023. The petitioner has made a representation dated 21.02.2025 to the respondents seeking to disburse his leave encashment benefits for the period 02/2019 with interest at the rate of 12% per annum from the said date of entitlement to till the date of actual disbursement. The said request has not been considered. Hence the present writ petition. 2/5

The learned Standing Counsel for the respondents would fairly admits that in view of the similar orders passed by this Court in W.P.Nos. 40031, 33742 and 35806 of 2024, they are willing to pay the interest at the rate of 6% per annum for the belated payment of the eligible and admissible amount.

4. Heard the learned counsel for both sides and perused the materials available on record.

In view of the above submission of the learned Standing Counsel, this Court deems it appropriate to direct the respondent to pay the interest at the rate of 6% per annum for the belated payment of terminal benefits, from the date of retirement till the date of actual disbursal of the terminal benefits of the petitioner along with other eligible and admissible amount, within a period of six weeks from the date of receipt of a copy of this order. 3/5

6. In the result, this Writ Petition is disposed of with the above observations. No costs.
