Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India to praying to issue a Writ of Mandamus, to direct the respondents 1 to 4 herein to remove the encroachment illegally made by the respondents 5 to 10 on the common pathway and the Water Canal by constructing and raising unauthorized compound wall as well as fencing on the Meikkal Government Poramboke lands comprised in Survey No.1454/1 and 1468, Thaiyur Village, Tiruporur Taluk, Chengalpattu District thereby restraining the petitioner to have access to the canal and for irrigation of his agricultural land, comprised in Nanja Survey No.469, measuring Acre 2.20 cents situate in Thaiyur Village, Tiruporur Taluk, Chengalpattu District based on the representation dated 14.03.2022 and to 1st respondent. (Order of the Court was made by C.KUMARAPPAN,J.,) The present Writ Petition has been filed to direct the respondents 1 to 4 to remove the encroachment in the water body made by the respondents 5 to 10.

2. At this juncture, the learned Additional Government Pleader would submit that they have already proposed to conduct an enquiry and survey of the land. In such process, if they find out any encroachments, they would take suitable action to remove the encroachment in accordance with the relevant provisions of the Act. To complete the above exercise, the learned Additional Government Pleader seeks for twelve weeks time.

3. In view of the above submission, we deem it appropriate to direct the respondents to survey the subject land, and if they find any encroachments they are directed to proceed under the relevant provisions of Act, to remove the encroachment within a period twelve (12) weeks from the date of receipt of a copy of this order, after affording opportunity to the parties.
