Petition filed under Article 226 of the Constitution of India, praying to issue a writ of Mandamus, to direct the respondents 1 to 4 to forbear them in any manner interfering with the petitioner's possession and enjoyment of land at S.No.6/17, to an extent of 0.0486.0 sq.mt. at Rajaganapathi Nagar, Mettur Dam, Mettur Taluk, Salem District. O R D E R

Heard Mr.M.Elango, learned counsel for the petitioners and Mr.M.Maharaja, learned Special Government Pleader appearing for the first and second respondents, Mr.V.Srikanth, learned counsel appearing for the third respondent, Mr.S.Saravanan, learned counsel appearing for the fourth respondent and Mr.T.M.Pappiah, learned Special Government Pleader appearing for the fifth to seventh respondents.

The petitioners have approached this Court, seeking the following relief, "To issue a writ of Mandamus, to direct the respondents 1 to 4 to forbear them in any manner interfering with the petitioner's possession and enjoyment of land at S.No.6/17, to an extent of 0.0486.0 sq.mt. at Rajaganapathi Nagar, Mettur Dam, Mettur Taluk, Salem District."

The case of the petitioners is as follows:- The apprehension of the petitioners is that the respondents 1 to 4 herein may take possession of the land under their enjoyment in Survey No.6/17, to an extent of 0.0486.0 sq.mt. illegally. According to the petitioners, the patta stands in their name and without any authority of law, the respondents 1 to 4, attempting to interfere with the rights of the petitioners.

When the matter was taken up for hearing, it is submitted by the learned counsel appearing for the respondents 1 to 4 herein that there was a wrong entry in the revenue records and the HR & CE Department had approached the Sub Collector for change of patta in favour of the temple. An application was made to that effect on 11.09.2013 itself and the same has not been disposed of as on date. Therefore, learned counsel would request this Court to give direction to the Sub Collector, Mettur, Salem District, to dispose of the application for change of patta dated 11.09.2013, within a stipulated time.

5. At this, learned counsel for the petitioners would submit that till the decision is taken by the competent authority, the petitioners' possession has to be protected and the petitioners ought not be disturbed, since they are being in occupation of the place for several years.

Considering the request of the petitioners and also the submissions made on behalf of the learned counsel for the respondents, the following direction is issued to the Sub Collector, mettur, Salem District, to dispose of the application filed on behalf of the HR & CE Department dated 11.09.2013, on merits and in accordance with law. After affording an opportunity of personal hearing to the petitioners, an order shall be passed by the competent authority, within a period of twelve weeks from the date of receipt of a copy of this order. In the meanwhile, the respondents or temple authorities should not attempt to interfere with the enjoyment of the possession of the petitioners in the subject land.

7. With the above direction, the writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
