ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to judicial custody on 12.04.2022 for the offences punishable under Sections 489B, 489C and 420 of IPC in Crime No.154 of 2022, on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the defacto complainant is a labour under the petitioner and the petitioner had given a five hundred rupees note to the defacto complainant towards his wage. Later, when the defacto complainant tried to use the said note, he found that the said note is a counterfeit. Hence the complaint.
3. Learned counsel for the petitioner would submit that the petitioner is innocent and there is no specific overt act against the petitioner and he has been falsely implicated in this case. He would further submit that the petitioner has been suffering incarceration from 12.04.2022. Hence, he prays for grant of bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/
4. Learned Government Advocate (Crl. Side) appearing for the respondent police raised objection for granting bail to the petitioner stating that there are totally 6 accused in this case and the petitioner is the prime accused/A1 and A6 is still absconding. He further submit that the investigation is still pending.
5. Considering the gravity of offence and pendency of investigation and objection from the learned Government Advocate (crl.side), this Court is not inclined to grant bail to the petitioner.
