In the affidavit filed in support of the judge's summons, it had been stated that the plaint copy could not be obtained to enable instructions to be given for filing the written statement. There was a delay.

Taking all the factors into consideration, the application stands allowed, delay is condoned and written statement of the defendants is to be taken on record.
