O R D E R

(The case has been heard through video conference) The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 430 and 379 IPC and Section 21(1) of Mines and Minerals (Development & Regulation) Act, 1957, in Crime No.337 of 2021 on the file of the respondent, seeks anticipatory bail.

2. It is the case of the prosecution that the petitioner is alleged to have custody of 30 units of river sand illegally in his premises. Hence the complaint.

3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. As per prosecution, the petitioner was kept 30 units of River sand in his own patta land No.1493, which is belongs to one Jaishankar S/o.Pachayappan and the petitioner is no way connected

with the alleged offence. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for the respondent submitted that 30 units of river sand was seized from the custody of the petitioner in his own land. He further submitted that the investigation has not been completed. Hence, he vehemently opposed for grant of anticipatory bail to the petitioner.

5. Considering the fact that 30 units of sand is involved and there is no change of circumstance, this Court is not inclined to grant anticipatory bail to the petitioner and accordingly, this Criminal original petition stands dismissed.
