.. Respondent Petition filed under Sections 11(4) of the Arbitration and Conciliation Act, 1996, to appoint a Sole Arbitrator to hear and decide the dispute amongst the parties arising out of the Letter of Understanding dated 10th August, 2006 and the extension letter dated 01.03.2011.

O R D E R

The learned counsel for parties state that since the arbitration clause is not in dispute nor the existence of the disputes or

the jurisdiction of this Court, the respondent may raise all their defences during the arbitration proceedings. The learned counsel for parties propose and agree that Ms.Preeti Mohan be appointed as the Sole Arbitrator, who has already been appointed in the other arbitration proceedings both by the petitioner and another theatre owner.

2. I, thus, appoint Ms.Preeti Mohan, Advocate, residing at No.31, Masilamani Road, Balaji Nagar, Chennai-14 (Mobile No.9940689973), who is present in Court and as agreed to by the learned counsel for parties, as the Sole Arbitrator to enter upon the reference and adjudicate the disputes inter se the parties. The arbitration proceedings will be conducted under the ageis of Madras High Court Arbitration Centre and the parties will be governed by the Rules of the Madras High Court Arbitration Centre (MHCAC) (Arbitration Proceedings) & (Administrative Cost and Arbitrators' Fees) Rules, 2014.

3. The Original Petition is, accordingly, allowed, leaving the parties to bear their own costs.
