PRAYER: Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure, to direct the learned Fast Track Court [Judicial Magistrate Level], Dharmapuri to disposal of the case, STC.No.15/2021 on merits as soon as possible preferably within a period of two months. ORDER

This Criminal Original Petition has been filed directing the learned Fast Track Court [Judicial Magistrate Level], Dharmapuri to dispose of the case in STC.No.15/2021, on merits as soon as possible preferably within a period of two months.

2. The learned counsel for the petitioner submitted that the petitioner filed a

case under Section 138 of Negotiable Instruments Act against the respondent and it is pending in STC.No.15/2021, on the file of the Fast Track Court [Judicial Magistrate Level], Dharmapuri. Non-Bailable Warrant is pending against the respondent from 24.02.2022. The case is pending without any progress. Therefore, this petition.

3. When the Non-Bailable Warrant is pending against the accused, this Court cannot set time limit for the disposal of the case. However, this Court directs the Fast Track Court [Judicial Magistrate Level], Dharmapuri to take immediate steps for execution of Non-Bailable Warrant and dispose of the case as expeditiously as possible, taking into consideration of the fact that the petitioner is a Senior Citizen.
