Writ Petition filed under Article 226 of the Constitution of India praying a writ of Mandamus, directing the first Respondent/State Level Scrutiny Committee herein, to complete the enquiry within the time stipulated by this Honourable Court with regard to the Status of the second respondent herein based upon the representations of the petitioner dated 03.06.2016, 13.01.2017 and 18.02.2017.

The Community Certificate of the second respondent was cancelled by the State Level Scrutiny Committee, by order dated 12 August, 2015. The order was challenged by the second respondent before this Court in W.P.No.28530 of 2015. The writ petition was taken up along with two other writ petitions filed by the second respondent. The Division Bench, by order https://hcservices.ecourts.gov.in/hcservices/

dated 1 December, 2015 set aside the order passed by the State Level Scrutiny Committee and directed fresh consideration of the question regarding the community status of the second respondent.

2. The petitioners, being the employer, took up the matter with the State Level Scrutiny Committee for the purpose of deciding the matter as expeditiously as possible.

3. The string of documents available on record indicates that the Chennai Port Trust has been requesting the State Level Scrutiny Committee to dispose of the proceedings as expeditiously as possible. However, there is nothing on record to indicate that the State Level Scrutiny Committee took up the matter pursuant to the order in W.P.No.28530 of 2015. We are therefore of the view that outer time limit should be fixed for disposal of the proceedings by the State Level Scrutiny Committee.

4. We direct the State Level Scrutiny Committee to dispose of the matter, pursuant to the order dated 1 December 2015 in W.P.No.28530 of 2015, as expeditiously as possible, and in any case, within a period of two months from the date of receipt of a copy of this order.

5. The writ petition is disposed of with the above direction. No costs.
