PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a writ of Certiorarified Mandamus, to call for the records pertaining to the impugned order passed by the 4th respondent vide his proceedings in Na.Ka.No.002381/B5(2)/2025 dated Nil.02.2025 and quash the same as illegal and incompetent subsequently direct the respondents to give effect the change of petitioner's erstwhile name Poulraj.U as Anbuselvan U in the Secondary School Leaving Certificate with register number 2174548 dated 23.05.2014 as per the publication made in the Tamil Nadu Government Gazatte dated 25.06.2014 in Page No.1759 as serial No 26032 within a stipulated time.

ORDER

The present writ petition has been filed seeking a mandamus to direct the respondents to change the petitioners name as Anbuselvan U in all the educational certificates namely Mark Sheet as well as Transfer Certificate.

The learned counsel for the petitioner submits that the petitioner's request was rejected on the ground that the name in the educational certificate cannot be changed based on a Gazatte Notification issued subsequent to the certificate was originally issued. It is the contention of the learned counsel that, once the Gazette Notification has been issued, it is incumbent upon the respondent authority to update the name in accordance 2/6

with the said Notification. Therefore, the petitioner prays for the impugned order to be quashed and for a direction to the respondents to carry out the necessary correction.

Per contra, the learned Special Government Pleader invited the attention of this Court in respect of the order passed in W.P.No.25677 of 2011 in M.P.Nos.1 & 2 of 2011 in R.Yogapriya vs. Joint Director of School Education, wherein this Court has held that "the petitioner has already published her Name Change in the Government Gazatte, the same is sufficient for all purposes and everybody is bound to accept the same as the Changed Name of the petitioner".

4. I have given my anxious consideration to either side submissions and also perused the materials available on record.

5. Therefore, in view of the aforementioned precedent, the issue raised in the present writ petition is no longer res integra. Therefore, this Court absolutely does not find any infirmity in the impugned order and the same is liable to be dismissed.
