ORDER
The Revenue Divisional Officer, Tindivanam is suo motu added as the 3 rd respondent in this writ petition.
2.This writ petition has been filed for issue of writ of mandamus directing the 1 st respondent to deal with the representation made by the petitioner on 08.03.2025, wherein, the petitioner is seeking for the cancellation of the patta issued in the name of the 2 nd respondent and for restoration of the patta in the name of the petitioner with respect to the subject property. 3.Heard Mr.A.J. Magendiraverman, learned counsel appearing on behalf of the petitioner and Mr.A.Selvendran, learned Special Government Pleader appearing on behalf of respondents 1 to 3.
3/5 4.In the considered view of this Court, the petitioner has to make a representation before the Revenue Divisional Officer, Villupuram, since the patta granted in favour of the 2 nd respondent has to be cancelled and the patta must be restored in the name of the petitioner. Hence, there shall be a direction to the petitioner to submit a fresh representation before the Revenue Divisional Officer, Tindivanam and on receipt of the same, the Revenue Divisional Officer, Tindivanam shall issue notice to the 2 nd respondent and conduct an enquiry and orders shall be passed on its own merits and in accordance with law, within a period of eight weeks from the date of receipt of fresh representation from the petitioner.
