Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorari, calling for the records of the Respondents in connection with the impugned order passed by the 1st respondent in Ref.No.H1(2)/ PR98/2012 DO No.1126/2013 dated.27.8.2013 and by the 2nd respondent in C.No.B2/AP70/17/13000/2013 dated 23.10.2013 and quash the same.

O R D E R

Challenging the order of punishment of compulsory retirement passed by the first respondent/Superintendent of Police, dated 27.08.2013, (impugned herein), the petitioner has preferred an Appeal to the Deputy Inspector General of Police, Vellore District, viz., the second respondent herein, and the said Appeal was dismissed by the second respondent, by the impugned order, dated 23.10.2013. The present Writ Petition is filed by the petitioner, seeking to quash the aforementioned orders, dated 27.08.2013 and 23.10.2013, passed by the first and second respondents respectively.

Today, when the Writ Petition is taken up for hearing, the learned counsel appearing for the petitioner submitted that https://hcservices.ecourts.gov.in/hcservices/

against the order passed by the second respondent, the petitioner desires to prefer further Appeal before the competent Authority, and hence, the learned counsel seeks permission of this Court to withdraw this Writ Petition, granting liberty to him to prefer further Appeal before the Competent Authority. The learned counsel has also made an endorsement to that effect in the Writ Petition today.

In view of the submission made by the learned counsel appearing for the petitioner, coupled with the endorsement, permission is granted. Accordingly, the Writ Petition is dismissed as withdrawn, with liberty to file further Appeal before the competent Authority. It is needless to say that, in case, the petitioner is aggrieved against the order passed by the competent Authority, it is open to him to file fresh Writ Petition. No costs.
