PRAYER: Criminal Original Petitions are filed under Section 439 of Criminal Procedure Code to enlarge the petitioner on bail in the event of his arrest in Crime No.794 of 2020 pending investigation on the file of the respondent police.

ORDER

(The case has been heard through video conference) The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 341, 393 of IPC altered to 341, 392 r/w 397, 506(ii) 363 and 511 of IPC in Crime No.794 of 2020 on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution is that on 04.07.2020, when the defacto complainant was returning home in his car, at that the accused way laid the defacto complainant at knife point and also kidnapped him for ransom. Thereafter, the public came to the occurence place, accused had ran away from the place along with a sum of Rs.16,000/- . Hence the complaint.

3. The learned Counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution and a false case has been foisted against him. He further submitted that based on the confession statment the petitioner was implicated in this case. https://hcservices.ecourts.gov.in/hcservices/

Hence, he prays for grant of anticipatory bail to the petitioner.

The learned Additional Public Proseuctor submitted that the petitioner along with other accused have way laid the defacto complainant and also snactched a sum of Rs.16,000/- from the defacto complainant. He further submitted that the custodial interrogation of the petitioner is essential. He further submitted that a sum of Rs.10,000/- and 4 knife and 2 Motor cycle have been recovered from the arrested accused persons. Hence, he vehemently opposed for grant of anticipatory bail to the petitioner.

5. Taking into consideration the allegations that the case is in the initial stage of the investigation and that the custodial interrogation of the petitioner is essential, this Court is not inclined to grant anticipatory bail to the petitioner. 6.This Criminal Original Petition stands dismissed accordingly. -sd/- 18/08/2020 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
