ORDER
The petitioner is before this Court against the order dated 15.03.2022, wherein, the demand proposed in notices dated 11.12.2017, 24.02.2020 and 03.09.2020 have been confirmed.
2. The impugned order appears to have been passed pursuant to personal hearing notice issued on 03.09.2020. There is a long delay between the last mentioned notice and the impugned order. It is noticed that in all the three notices that were issued to the petitioner, two of the notices were issued during the time when the Country was bracing to face the outbreak of Covid - 19 Pandemic and thereafter, when the Country was under lockdown during the month of September, 2020. Thereafter, the respondent called upon the petitioner to respond to the allegations mentioned in the notices mentioned above.
3. Thus, it is clear that the impugned order has been passed in violation of principles of natural justice. Therefore, the impugned
order is quashed and the case is remitted back to the respondent to pass fresh orders, on merits and in accordance with law, taking note of the decision of this Court in the case of Sahyadri Industries Ltd. vs. The State of Tamil Nadu1.
4. The writ petition, accordingly, stands disposed of. There shall be no order as to costs. Consequently, W.M.P.No.13342 of 2022 is closed.
