ORDER
This application has been filed to Restore the above Petition No.T)OP(TM) No.284 of 2023 on the file of this Hon'ble Court.
2. Heard both sides.
3. The notice attempted to be served on the first respondent had been returned with an endorsement "No Such Person". It is to be noted that the first respondent had been set ex parte by orders of this Court on 14.11.2024 and in that regard, the presence of the first respondent is not necessary to entertain the present application, which is to restore the original petition, that came to be dismissed for non prosecution on 13.03.2025.
4. The present application had been filed along an application to condone the delay and by order dated 26.02.2026, the reasons attributed for the delay were accepted and the delay stood condoned. The reasons attributed by the applicant for condoning the delay as well as for restoring the application are that, on the said date the counsel had appeared through Video Conferencing and in view of certain technical glitches, the voice was not audible to the Hon'ble Court.
5. In support of the said claim, a screenshot of the proceedings was also placed before this Court, which would indicate that the counsel, who had logged in with the ID: "Saumya Bajpai", had attended the Court proceedings on the said date.
6. In view of the same, this Court is of the view that no prejudice would be caused to any of the respondents if the original petition is restored and adjudicated on its merits. Accordingly, this application stands ordered as prayed for. No costs.
