ORDER
The writ petition has been filed to issue a mandamus to the respondents to pay the terminal benefits to the tune of Rs.31,19,160/- to the petitioner such as Gratuity, Provident Fund, Dearness Allowance, Leave Salary, Deposit etc., together with interest at the rate of 18 % per annum from the date of superannuation till the date of payment within a time frame. 2.
The case of the petitioner is that he was appointed as Office Assistant in the Kulamanikkam Primary Agriculture Co-operative Society/third respondent herein on 26.09.1985 and retired from service in the same cadre on attaining the age of superannuation on 31.03.2018. Though the third respondent society had passed a resolution on 28.03.2018 and resolved to disburse a sum of Rs.15,91,408/- towards terminal benefits to the petitioner, the same has not been disbursed to the petitioner till date. Hence, the petitioner has filed this writ petition with the above mentioned prayer.

Heard the learned counsel for both sides and perused the materials available on record.

Considering the facts and circumstances of the case, the third respondent is now directed to pay the terminal benefits of the petitioner on or before 23.06.2026, in the light of the resolution passed by the third respondent dated 28.03.2018, along with interest at the rate of 6% per annum from the date of retirement till the date of actual disbursal of the terminal benefits. 5.
Accordingly, the writ petition is allowed. No costs. 6.
