ORDER

Heard the learned counsel for the writ petitioner and the learned Standing Counsel for R1 to R3 and learned Standing counsel for R4 and R5.

2. Considering the nature of relief to be granted, issuance of notice to the fifth respondent is dispensed with. https://hcservices.ecourts.gov.in/hcservices/

3. The petitioner was married to the fifth respondent. The marriage between the petitioner and the fifth respondent was dissolved through mutual consent. A male child was born to them. Thereafter, an application has been submitted to the Kendriya Vidyalaya Sangathan for admission of the child under the Category I. However, the school management requires service certificate certifying that the father of the child is working in the fourth respondent/ICF.

4. Since the marriage between the petitioner and the fifth respondent has been dissolved, it is quite possible that the fifth respondent is not willing to co-operate. However, it has been confirmed by the fourth respondent that the fifth respondent is indeed working in ICF. The fourth respondent also undertakes to issue service certificate in this regard to the writ petitioner by tomorrow. The petitioner is directed to approach the fourth respondent tomorrow itself and the fourth respondent shall issue the necessary service certificate to the petitioner. It is for the petitioner to work out the issue regarding the admission of the child, based on the said certificate. The writ petition is allowed accordingly. No costs. Consequently, connected miscellaneous petition is closed.
